Terms of Use

01

Operator and Agreement

Desk Solutions operates the YA Markets product and website at desksolutions.io. In these Terms, YA Markets, we, us, and our refer to Desk Solutions as the service operator.

These Terms apply to the website, Markets Hub, Dashboard, Toolkit, Monitor, Confluence, Chat Room, Scripts, Learning, Downloads, Paper Trading, account features, and related YA Markets services. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

02

Eligibility

You must be at least 18 years old and legally able to enter this agreement. If the age of legal majority where you live is higher, that higher age applies.

You are responsible for confirming that your access to online, market-analysis, financial-information, and trading-related services is lawful in your location.

03

Service Purpose

YA Markets provides charting, factual market information, education, workflow tools, watchlists, indicators, templates, monitoring, scripts, dashboards, and analytical context.

The service is not a broker, exchange, custodian, wallet, trade-execution venue, portfolio manager, or provider of advice tailored to your objectives, financial situation, or needs. We do not hold client money or place trades for you.

Do not treat a chart, alert, target, invalidation level, confidence label, model, script, dashboard read, or other output as an instruction or personal recommendation to trade.

04

Independent Decisions and Market Risk

Trading and investing can result in partial or total loss of capital. Leverage, margin, derivatives, futures, crypto assets, forex, metals, indices, stocks, and commodities may move quickly and involve additional platform, liquidity, funding, liquidation, and counterparty risks.

You remain responsible for your own research, suitability assessment, professional advice, risk limits, orders, positions, transfers, tax reporting, and legal compliance. Past performance, backtests, examples, simulations, and prior outputs do not predict future results.

05

Paper Trading

Paper Trading is an account-scoped simulation that uses virtual funds and provider-referenced prices. It does not create a brokerage, exchange, wallet, or custody account; no real money or asset changes hands; and no order is routed to a live venue.

Crypto and equity reference simulations use virtual cash holdings, while supported cTrader broker markets use normalized 1x directional exposure. Equity references do not confer ownership, shareholder rights, dividends, or any interest in the referenced company or asset.

Displayed prices, simulated bid/ask fills, position marks, and profit or loss may be delayed, incomplete, unavailable, or materially different from live execution. Virtual results do not include every fee, tax, financing cost, liquidity constraint, rejection, partial fill, slippage, market impact, or behavioral effect of trading real funds.

Virtual balances, positions, and fills have no cash value, cannot be withdrawn or transferred, and do not evidence a real transaction or entitlement against a provider.

06

Accounts and Security

Provide accurate account information, keep your credentials and devices secure, and tell us promptly if you suspect unauthorized use. You are responsible for activity performed through your account unless applicable law provides otherwise.

Accounts are personal unless we agree otherwise in writing. You must not share or resell access, impersonate another person, bypass entitlements, scrape or overload the service, interfere with security, misuse APIs, upload malicious material, or use the service unlawfully.

07

Chat Room and Member Content

The Chat Room is a shared Essential and Expert member space. Your handle, avatar, text messages, privately stored photo messages, reactions, timestamps, and other contributions may be shown to eligible room members. Reports are sent for review and are not treated as public room posts.

Live market reads, trade setups, and execution commentary shared by an administrator or member are general information and discussion. Their appearance in the Chat Room does not make them personal advice, an instruction to trade, or a promise of performance.

Keep contributions lawful, relevant, and respectful. Do not post personal or confidential information you are not authorized to disclose; unlawful, infringing, deceptive, abusive, harassing, discriminatory, manipulative, or malicious material; spam; impersonation; fabricated results; guaranteed-return claims; or content designed to pressure another person into a financial transaction.

Desk Solutions may set room and media limits, pause member posting, pin notices, review reports, moderate messages, hide or restore content, and restrict Chat Room or account access where reasonably necessary for safety, moderation, security, service integrity, or enforcement of these Terms. Clearing the active room view does not promise immediate deletion; relevant records may remain for moderation, security, dispute handling, backup, and scheduled retention.

08

Membership Approval

Registration, email verification, and payment verification do not by themselves activate member access. Explore and Essential requests remain pending until Desk Solutions approves them. We may request further information or decline an application where reasonably necessary for security, capacity, compliance, product fit, or service operation.

Access is controlled by the approved account, membership state, and feature entitlements. Expert access requires an active Essential membership and a separate application. Custom work may also require a separate written scope and price.

09

Explore

Explore is a one-time seven-day trial that starts only after Stripe payment-method verification and Desk Solutions approval. Stripe Setup Checkout saves a reusable payment method without charging a membership fee at verification.

Auto-renewal to Essential is optional and off by default. If you expressly select it, an Essential subscription is scheduled to begin after the approved seven-day trial at the price shown before consent. If Explore is rejected, we clear the related renewal consent and verification state and instruct Stripe to remove reusable payment methods associated with that application. A later application requires fresh verification.

10

Essential

Essential currently uses Stripe subscription Checkout at US$100 per month, inclusive of tax as configured at checkout. The initial subscription charge is made at Checkout, but workspace access remains pending until Desk Solutions approval.

Monthly renewal is optional and off by default in the registration flow. If you purchase Essential without selecting renewal, the subscription is scheduled to end at the close of the first paid period. If Essential is rejected before approval, the subscription is cancelled, the payment from the approval Checkout invoice is submitted for a full refund, and reusable payment authority from that application is removed.

11

Billing and Cancellation

Stripe processes payment-method verification, charges, subscriptions, invoices, refunds, Apple Pay, and Link where available. Stripe may apply its own identity, fraud, authorization, regional, and service rules.

When an account has a managed subscription, the YA Markets Manage Account page may open Stripe's Billing Portal for payment-method, invoice, renewal, and cancellation controls. Cancellation normally stops future renewal and does not automatically reverse a completed period, subject always to the Refund Policy and rights that cannot be excluded by law.

12

Data, Tools, and Availability

Market data and derived outputs may be delayed, stale, incomplete, inaccurate, normalized differently between providers, or unavailable. Providers may change their feeds, permissions, symbols, or terms without notice.

We may maintain, change, suspend, replace, or withdraw a feature or data source. We do not promise uninterrupted operation, continuous live data, alert delivery, compatibility with every device or third-party platform, or error-free calculations.

13

Third-Party Services and Affiliate Links

The service may link to or embed providers such as market-data services, exchanges, brokers, wallets, TradingView, YouTube, and payment platforms. Your use of a third-party service is governed by that provider's terms, privacy practices, eligibility rules, fees, and risks.

Some links may be affiliate or referral links. Desk Solutions may receive compensation if you use them. Compensation does not make a provider suitable for you and does not replace your own due diligence.

YA Markets may record use of a partner link or referral-code control and may reconcile referral status reported by a provider. These records support route administration and attribution; they do not establish suitability, endorsement, account approval, trading performance, or any entitlement with the provider.

14

Intellectual Property and User Material

YA Markets branding, interface, text, workflows, layouts, templates, calculations, scripts, and original content are owned by or licensed to Desk Solutions. Third-party data, marks, software, widgets, and content remain owned by their respective owners.

Your membership gives you a limited, revocable, non-transferable right to use the service for personal use within your entitlement. You may not copy, publish, sublicense, sell, clone, or commercially exploit protected YA Markets material without written permission.

If you submit feedback, support material, Chat Room content, or other material, you confirm that you have the right to submit it. You retain any rights you hold in that material and give Desk Solutions the limited permission needed to host, store, reproduce, display, transmit, moderate, and remove it to operate, secure, support, and improve YA Markets, including for the retained records described in these Terms and the Privacy Policy.

15

Suspension and Termination

We may restrict, suspend, or close access where reasonably necessary to address non-payment, fraud, abuse, unlawful activity, security risk, entitlement bypass, material breach, provider restrictions, or risk to other users or the service.

Where practical and lawful, we will consider the circumstances and any available correction before permanent closure. Ending an account does not remove payment, refund, intellectual-property, dispute, or record-retention obligations that by their nature continue.

16

Consumer Rights and Liability

Nothing in these Terms excludes, restricts, or modifies a guarantee, right, remedy, or liability that cannot lawfully be excluded, including any applicable rights under the Australian Consumer Law.

Subject to those rights, the service is supplied on an as-available basis. To the maximum extent permitted by law, Desk Solutions is not responsible for trading or investment losses, third-party failures, indirect or consequential loss, lost opportunities, or loss caused by reliance on delayed, incomplete, or incorrect market information.

17

Changes

We may update these Terms or the service as the product, providers, laws, and operating requirements change. The current version will be posted on desksolutions.io.

Material changes affecting a paid membership will be communicated by reasonable means before they take effect where required. We will obtain additional consent where the law or the nature of the change requires it.

18

Governing Law and Contact

These Terms are governed by the laws of New South Wales, Australia, and disputes may be brought in its courts, except where mandatory law gives you a right to use another forum or applies different protections.
